    Content Guidelines

    Obscene Programming*Obscene programming is not allowed on TVSB channel(s). Does the program you are submitting contain any obscene material per the following definition: The United States Supreme Court in 1974 under Miller vs. California, 413 US 15, 24 defines obscenity as: A work, which taken as a whole (1) appeals to the prurient interest, (2) depicts or describes sexual conduct in a patently offensive way and (3) lacks serious literary, artistic, political, or scientific value. To be considered obscene all three criteria must be met. Prurient is defined as: Marked by, arousing, or appealing to unusual sexual desire. Patently is described as: Readily visible or intelligible: obvious

    Indecent Programming*Programming that is indecent, as defined by the Federal Communications Commission will be scheduled between 10:00 pm and 5:00 am. Does the program you are submitting contain any indecent material per the following definition: Indecency is described as: Descriptions or depiction of sexual or excretory functions that are patently offensive under contemporary standards applicable to the broadcast medium. Specified profane words.

    Adult Content*Adult Content - Some material, such as adult situations, profane language, nudity, excessive violence, sexually explicit content or graphic depictions of surgical procedures may be unsuitable for viewing by children. Programming containing adult content will be scheduled between 10:00 pm and 5:00 am. Does the program you are submitting contain any material not suitable for children?

    Program meets TVSB Programming Policies Statement*By submitting this form, I represent to TV Santa Barbara, that the program presented by me for scheduling as described on this Programming Contract does not contain (1) any advertising or material that promotes any product, service, or lottery; or (2) material which violates any law including but not limited to obscene material, libel, invasion of privacy, violation of trademark, or copyright infringement. By signing this contract, I am assuming full responsibility and will be held legally accountable for the content of this programming and as such may be subject to prosecution for program content that violates any local, state, or federal law. I have read and agree to abide by all TVSB policies regarding use of TVSB channels and facilities. I agree to indemnify and hold harmless TV Santa Barbara, COX Cable, and all governments having service agreements with the foregoing, and all their respective staffs and governing boards, from any liability, loss or damage, including reasonable attorney’s fees and court costs, caused by any claim of legal action arising out of the cablecast of the programming submitted by me. I have received appropriate releases for any copyrighted material used in the program. I have the authority to submit this programming as the producer or as the authorized agent of the sponsoring organization. TVSB has the non-exclusive right to air cablecast the program, stream the program on the internet, or host on any on-demand platform. TVSB has the authority to make copies of submitted programs in response to public requests or for promotional or other purposes.
